ABSTRACT By means of the high ratings that they awarded to subprime mortgage‐backed bonds, the three major rating agencies—Moody's, Standard & Poor's, and Fitch—played a central role in the current financial crisis. Without these ratings, it is doubtful that subprime mortgages would have been issued in such huge amounts, since a major reason for the subprime lending boom was investor demand for high‐rated bonds—much of it generated by regulations that made such bonds mandatory for large institutional investors. And it is (...) even less likely that such bonds would have become concentrated on the balance sheets of the banks, for which they were rewarded by capital regulations that tilted toward high‐rated securities. Why, then, were the agencies excessively optimistic in their ratings of subprime mortgage‐backed securities? A combination of their fee structure, the complexity of the bonds that they were rating, insufficient historical data, some carelessness, and market pressures proved to be a potent brew. This combination was enabled, however, by seven decades of financial regulation that, beginning in the 1930s, had conferred the force of law upon these agencies' judgments about the creditworthiness of bonds and that, since 1975, had protected the three agencies from competition. This paper discusses findings from a research study that investigated the experience of being a breastfeeding woman in New Zealand. The study was motivated by a desire to better understand why the majority of New Zealand women wean their infants before 6 months of age, despite the benefits of prolonged breastfeeding being well accepted. Nineteen women, who were breastfeeding or had recently breastfed, were engaged in unstructured interviews about their experience, and the results were examined using a reflective lifeworld research (...) methodology. The findings presented here demonstrate that women often employ an interpretive framework that is aligned with the philosophical tradition of Descartes’ mind–body split, also know as Cartesian dualism. This leads to a widely held perception of the breast as an object, which emerged in the participants’ narratives and is explored using Heidegger's philosophical interpretation of equipment. We conclude that the objectification of the breast in our society fails to provide women with language that describes the breastfeeding experience in a meaningful way, thus undermining women's ability to articulate and reconcile their embodied breastfeeding experiences. The standard allocative efficiency criteria used by economists (Pareto efficiency and Kaldor-Hicks efficiency) are fundamentally unable to rank a slave-labor system against a free-labor system. Given either set of initial property rights assignments the market can reach (or fail to reach) allocative efficiency (that is, allocate resources to their highest-valued uses), but welfare economics provides no meta-framework for ranking initial assignments. This finding underscores the limits to the usefulness of efficiency criteria: they cannot settle all questions, and unfortunately are least (...) decisive just where the stakes are greatest (namely, where wealth effects of alternative assignments are greatest). Israel Kirzner cautions us that, because commodity price arbitrage as such does not operate outside commodity markets, the logic of Pareto-improving entrepreneurship does not provide a “copybook example” for explaining the evolution of social institutions in general. He characterizes Menger’s theory of the emergence of money as non-entrepreneurial; by implication, while it assures us that some monetary standard will emerge, it does not assure us that a superior monetary standard will spontaneously emerge. I argue that entrepreneurial opportunities for private gain (...) do in fact drive the Mengerian evolution from barter to money, and systematically promote the emergence of superior monetary standards, though not necessarily the best conceivable standards. Wilkinson (1991) suggests that the problems of polarity decisions and homoplasy in a cladistic analysis may be solved if cladists simply accept plesiomorphy as a reliable indicator of monophyly. Here we argue that: (1) Wilkinson's argument is based on misapprehension of synapomorphy and the problem of homoplasy; (2) His proposed methodology fails to consider the full ramifications of rooting, polarity, and parsimony; and (3) His method does not solve the problems he raises. We demonstrate the limitations of this methodology by (...) using Wilkinson's practical example. We find no justification for the assertion that plesiomorphy may reliably delimit monophyly and recommend against Wilkinson's suggested methodological revisions. (shrink)

During the Nazi era, most German physicians abrogated their responsibilities to individual patients, and instead chose to advocate the interests of an evil regime. In so doing, several fundamental bioethical principles were violated. Despite gross violations of individual rights, many physicians went on to have successful careers, and in many cases were honored. This paper will review the case of Hans Sewering, a participant in the Nazi euthanasia program who became the President-elect of the World Medical Association. The appropriate stance (...) for the medical and scientific community toward those who violate human rights and ignore fundamental ethical principles of the healing professions will be considered. Few figures of the Middle Ages command the attention of so many modern disciplines as Robert Grosseteste (c. 1170-1253). Theology, Philosophy, History, and Science are all areas which his life and thought continue to have significance and to inspire re-interpretation. Accompanied by a series of original commentaries, this new edition of Grosseteste's work, with English translation, draws together the perspectives of modern scientists and medieval specialists. Volume I of a six volume series, Knowing and Speaking presents two of the earliest (...) of Grosseteste's works, the treatises On the Liberal Arts and On the Generation of Sounds. These are accompanied by a significant Middle English treatise on the Seven Liberal Arts whose anonymous fifteenth-century author translated and excerpted passages from Grosseteste's treatises in a re-imagining of their structure and function.0Each work is treated separately within the volume, which is constructed in three parts. On the Liberal Arts sets Grosseteste's thoughts on the arts subjects and emphasises moral concerns about the purpose of learning. Dyadic play fighting occurs in many species, but only humans are known to engage in coalitional play fighting. Dyadic play fighting is hypothesized to build motor skills involved in actual dyadic fighting; thus, coalitional play fighting may build skills involved in actual coalitional fighting, operationalized as forager lethal raiding. If human psychology includes a motivational component that encourages engagement in this type of play, evidence of this play in forager societies is necessary to determine that it is not an artifact (...) of agricultural or industrial conditions. We examine whether coalitional play fighting appears in the hunter-gatherer record and includes motor skills used in lethal raiding. Using the ethnographic record, we generated a list of motor patterns regularly used in forager warfare. Then, using Murdock’s Ethnographic Atlas, we identified 100 culture clusters containing forager societies and searched the ethnographic records of these societies for descriptions of coalitional play fighting, operationalized as contact games played in teams. Resulting games were coded for the presence of eight motor patterns regularly used in forager lethal raiding. Although play does not tend to be systematically documented in the hunter-gatherer literature, sufficiently detailed descriptions of coalitional play were found for 46 of the 100 culture clusters: all 46 exhibited coalitional play using at least one of the predicted motor patterns; 39 exhibited coalitional play using four or more of the eight predicted motor patterns. These results provide evidence that coalitional play fighting occurs across a diverse range of hunter-gatherer cultures and habitats, regularly recruits motor patterns used in lethal raiding, and is not an artifact of agricultural or industrial life. This is a first step in a new line of research on whether human male psychology includes motivations to engage in play that develops the deployment of coordinated coalitional action involving key motor patterns used in lethal raiding. We examine the ethical, social, and regulatory barriers that may hinder research on therapeutic potential of certain controversial controlled substances like marijuana, heroin, or ketamine. Hazards for individuals and society and potential adverse effects on communities may be good reasons for limiting access and justify careful monitoring of these substances. Overly strict regulations, fear of legal consequences, stigma associated with abuse and populations using illicit drugs, and lack of funding may, however, limit research on their considerable therapeutic potential. We review (...) the surprisingly sparse literature and address the particular ethical concerns pertinent to research with illicit and addictive substances, such as undue inducement, informed consent, therapeutic misconception, and risk to participants, researchers, and institutions. We consider the perspectives of key research stakeholders and explore whether they may be infected with bias. We conclude by proposing an empirical research agenda to provide an evidentiary basis for ethical reasoning. (shrink)

The dispute about the role of class in understanding the life situations of people of color has tended to be overpolarized, between a class reductionism and an “it's only race” position. Class processes shape racial groups’ life situations. Race and class are also distinct axes of injustice; but class injustice informs racial injustice. Some aspects of racial injustice can be expressed only in concepts associated with class (e.g., material deprivation, inferior education). But other aspects of racial injustice or other harms, (...) such as racial discrimination or stigma, are not reducible to class concepts and cannot be fully addressed through class-focused policies. Overall, any attempt to fully secure racial justice for a racial group will require a combination of race-focused and class-focused policies. Anti-racist outlooks often neglect or downplay either the normative or the explanatory significance of class, or both—for example, by overlooking or downplaying the dignitary harms of class and the material harms of race; missing the historical dimension of class injustice; masking class by a narrowing of the complex normative structure of racial disparities; or not recognizing that a class-focused initiative (like raising the minimum wage) can address substantial racial justice concerns, even though not all of them. “Systemic racism” terminology recognizes class explanatorily but suppresses it normatively. Charles Mills's influential notion of “white supremacy,” while a powerful tool for conceptualizing and illuminating racial injustice, can also contribute to minimizing or masking the justice-related impact of class, as do some of Mills's specific discussions of class in various writings. My study aims to offer a Schopenhauerian reading of Henry James's The Portrait of a Lady and D. H. Lawrence's The White Peacock. Throughout the dissertation, I am driven by two goals. First, I aim to examine the selected novels by considering Schopenhauer's philosophy. Secondly, I shall investigate why characters, especially the heroines, having recognised that their marriage was basically a mistake, still remained in their tormented relationships. Why it is important to answer this question and what (...) makes this a unique concern, especially in James's novel, is the possibility that previous studies and many other critiques have questioned the destiny of these heroines in regard to the novelists' anti-feminist tendencies or their social and personal concerns, while I believe that by using Schopenhauer's philosophy I can provide a deeper conceptualisation of the novels' ending. In so doing, in the second chapter I will describe the reception of Schopenhauer's philosophy in England, and the direct and indirect presence of his philosophy in Lawrence's and James's Works. In the third chapter, I concentrate on Schopenhauer's concept of freedom, morality and the will in James's novel. My fourth chapter considers Lawrence's philosophy of love and reveals how his philosophy differs from Schopenhauer's. Furthermore, it draws his readers' attention to the Schopenhauerian notion of the will-to-live, acknowledged in Lawrence's novel. (shrink)

It is often asserted that Newman was an invisible peritus at the Second Vatican Council—in a sense, Newman was a “Father of the Modern Church.” But what does it mean to be a “Father of the Church”? This article reflects on selected aspects of Newman’s thought that were influential at Vatican II and continue to be important today.

The promise of a free, high-quality public education is supposed to guarantee every child a shot at the American dream. But our widely segregated schools mean that many children of color do not have access to educational opportunities equal to those of their white peers. In Integrations, historian Zoë Burkholder and philosopher Lawrence Blum investigate what this country’s long history of school segregation means for achieving just and equitable educational opportunities in the United States. Integrations focuses on multiple (...) marginalized groups in American schooling: African Americans, Native Americans, Latinxs, and Asian Americans. The authors show that in order to grapple with integration in a meaningful way, we must think of integration in the plural, both in its multiple histories and in the many possible definitions of and courses of action for integration. Ultimately, the authors show, integration cannot guarantee educational equality and justice, but it is an essential component of civic education that prepares students for life in our multiracial democracy. When conceived as an empirical claim, it is natural to wonder how one might test the hypothesis of multiple realization. I consider general issues of testability, show how they apply specifically to the hypothesis of multiple realization, and propose an auxiliary assumption that, I argue, must be conjoined to the hypothesis of multiple realization to ensure its testability. ABSTRACT Enlightenment liberalism has come under furious attack from multiple sources in recent years, including cognitive science, the social sciences, identity politics of the left, and populism and nationalism on the right. The notions of individual liberty, free speech, and broad rights protections operating under neutral procedural law has been tied to elitism, patriarchy, white supremacy, and oppressive capitalism. This article points out that recent criticisms from progressives and conservatives are not new. They were mostly formulated several decades ago. (...) Further, they commonly create a straw liberalism, failing to recognize the complexity of the Enlightenment liberal tradition. They ignore the fact that the validity of the institutions and processes of liberalism can, indeed must, be accepted, regardless of criticisms of simplistic versions of liberal theory. For those liberal institutions and processes remain the only known means for controlling the forces of modernity on which we all depend. (shrink)

In the face of limited resources during the COVID-19 pandemic response, public health experts and ethicists have sought to apply guiding principles in determining how those resources, including vaccines, should be allocated.

The Black Lives Matter movement calls attention to the injustice involved in police killings of blacks and implicitly proposes that a particular emotional attitude--caring about the life of a human being not known personally to oneself--should have been, but was not, present in the police officers involves in these killings. I examine five prominent such killings, but especially Michael Brown, Eric Garner, and Tamir Rice [the article was written before the killing of George Floyd] for the character of the moral (...) failing involved in them, focusing especially on the police failure to aid once the subjects were subdued after being shot or taken down. The failure to care about life is not fully captured by three alternative, though complementary, moral failings--stereotyping, implicit bias, and failing to recognize the rights of black people. I then rebut four objections proposed by a police commissioner to my 'black lives matter' moral framework--(1) that shifting from an aggressive mindset toward someone perceived as a potential threat to a caring one is not possible; (2) that we should be concerned about behavior, not emotions; (3) that police officers kill white people also; and (4) that black police officers are sometimes perpetrators of the killings. Different socioeconomic backgrounds and barriers to education have contributed to low­er educational achievement among blacks, Latinos, and Native Americans, compared to American whites and Asians. The failure of legal integration to close the racial achieve­ment gap is the result of prejudice on the part of teachers, as well as a scarcity of cultur­ally relevant curricula materials for nonwhite children. As a plausible solution to these problems, recent studies show that poor children do better in classes where middle-class children are also (...) present. Middle-class children already have habits and values that sup­port success in the educational system. Integrated schools are not sufficient, because they are often divided in “tracks” that reproduce racial segregation. Racial diversity in the K-12 classroom is fruitful preparation for civic engagement in a pluralistic society made up of citizens from diverse backgrounds. (shrink)
